Joint Summary of the Meeting

 

The Heads of the ASEAN Intellectual Property (IP) Offices and the Executive Director of the European Union Intellectual Property Office (EUIPO), in their meeting in Alicante, Spain on 2nd October 2015 in the context of the EU-ASEAN Project on the Protection of Intellectual Property Rights (ECAP III Phase II):

 

  • Acknowledged the importance of trademarks, industrial designs and geographical indications in the economies of the ASEAN region and the European Union and the essential role of these IP rights in ensuring that ASEAN and European businesses continue to flourish;
  • Recognised their desire to continue to work together towards enhancing the capacity of the ASEAN IP Offices to provide high quality, efficient, and cost-effective services to the business community in the areas of trademarks, industrial designs and geographical indications, thereby contributing to the economic development of the ASEAN region and to making it easier to do business in ASEAN;
  • Appreciated the fact that the ASEAN Economic Ministers, at their 47th Meeting held on 22nd August 2015 in Kuala Lumpur, Malaysia, had recognized with satisfaction the work done by the ASEAN Member States in the field of IP particularly in the context of the ECAP III Phase II,  such as the adoption of Common Guidelines on Substantive Examination, the finalization of the ASEAN List of Goods and Services and the launch of on-line search tools, namely ASEAN TMview, ASEAN TMclass and ASEAN Designview, that “will contribute towards improving the quality of the services provided in the area of trademarks and industrial designs”;
  • Recognized that those outcomes are the result of the close collaboration among the ASEAN IP Offices and the EUIPO, and this has reinforced the synergies created in line with Strategic Goals 4 and 5 of the ASEAN IPR Action Plan 2011-2015 which provide for “closer relationships with dialogue partners and institutions to develop the capacity of Member States and to address the needs of stakeholders in the region and intensified cooperation among ASEAN Member States and increased level of collaboration among them to enhance human and institutional capacity of IP Offices in the region”;
  • Reaffirmed the importance of the extension of the ECAP III Phase II until February 2017 in order to continue the fruitful collaboration between the ASEAN IP Offices and EUIPO and to complete the initiatives that have yet to be concluded;
  • Exchanged views and identify synergies on areas of focus of the ASEAN Member States, including the priorities and interests of Cambodia, Lao PDR and Myanmar and key elements of the ASEAN IPR Action Plan 2016-2025 and the highlights and priorities of the EUIPO;
  • Reaffirmed their intention to continue to strengthen their joint efforts towards improving the protection of IP, specifically trademarks, designs and geographical indications, including IT tools and databases, and developing innovative mechanisms directed at creating more appropriate conditions for the protection and use of those rights to support balanced and highly effective IP systems for the economic development of the ASEAN region and for the benefit of stakeholders in general, and the business community, in particular;
  • Resolved to intensify their collaboration to attain a highly effective IP system in the ASEAN region for both ASEAN and EU nationals in the context of a new ASEAN IP Project on IP supported by the European Union and implemented by EUIPO, and fully aligned with the new ASEAN IP Rights Action Plan 2016-2025.
  • Agreed to hold the Third ASEAN-EUIPO Heads of IP Offices Meeting back-to-back with one of the three annual AWGIPC Meetings to be held 2016.

 

The ASEAN Member States, taking into account the assistance envisioned for the IPR Action Plan 2016-2025 within the framework of the future ASEAN-EU Cooperation Programme, expressed strong support for the approval of the new ASEAN-EU Cooperation Programme, with the EUIPO as implementing agency.

 

The ASEAN Heads of IP Offices and the Executive Director of EUIPO adopted this Joint Summary of the Meeting in Alicante, Spain on 2nd October 2015.
